WASHAKIE COUNTY BURNING REGULATIONS

  1. NOTIFY WASHAKIE COUNTY DISPATCH CTR AT 347-2242.

     RESPONSIBLE PARTY SHALL PROVIDE:

a)     LOCATION & ACCESS OF CONTROLLED BURN.

b)     NATURE OF BURN. (Pile, Ditch, Open Area-Natural, Field)

c)     NAME & CONTACT INFO 


  1. TIME OF BURNING 6:00A TO 6:00P

(This helps prevent burning during times smoke would be affected by an inversion.)


  1. NO FIRE SHALL BE STARTED IF WIND IS CURRENTLY OR EXPECTED TO EXCEED 15 MPH DURING BURN.

  1. WIND WILL BE BLOWING AWAY FROM POPULATED AREAS WHEN BURN BEGINS.

POPULATED AREAS INCLUDE, BUT AREN'T LIMITED TO, PORTIONS OF PROPERTY NORMALLY OCCUPIED AS RESIDENTIAL, RECREATIONAL, INSTITUTIONAL, COMMERCIAL, OR EDUCATIONAL PREMISES, BUT DON'T INCLUDE FIXED AREAS UNDER CONTROL OF OPEN BURNER.  OPEN BURN, EXCEPT FOR FENCELINE, IRRIGATION DITCH OR CANAL BURNS, SHALL NOT BE CONDUCTED WITHIN 500 FT OF A POPULATION. 


  1. RESPONSIBLE PARTY SHALL BE ON SITE OF CONTROLLED BURN AT ALL TIMES & HAVE A WAY TO MANAGE CONTROLED BURN TO HELP PREVENT AN OUT OF CONTROL WILDLAND FIRE.

 (Examples: Water for suppression, Personnel with hand Tools, or Tractor with disking ability)
 

6.     RESPONSIBLE PARTY SHALL MEET ADDITIONAL WY DEPT OF ENVIRONMENTAL QUALITY REQUIRMENTS FOR FOLLOWING TYPES OF CONTROLLED BURNS:
 

A)    CROP BURNS >130 ACRES

B)    RANGELAND/PASTURELAND BURNS >68 ACRES

C)   VEGETATIVE PILES >1250 CUBIC FT

D)   ANY NON-VEGETATIVE OPEN BURNING; EXCEPT burns for recreational purposes OF cooking food, providing warmth for human beings, & branding of animals.

WASHAKIE COUNTY FIRE WARDEN MAY SUSPEND ALL BURNING BASED ON A RED FLAG WARNING  OR HIGH WIND WARNING BEING ISSUED FROM NTL WEATHER SERVICE. WASHAKIE COUNTY DISPATCH WILL ADVISE CALLERS IF BURNING HAS BEEN SUSPENDED.

  1. During burn restrictions, discharge of fireworks &d all outdoor fires are prohibited in unimproved areas defined as cropland, agricultural land, & undeveloped land which predominately remains in its natural forested or range condition, except as provided below:
    1. Trash or refuse burned between hrs of 6:00p - 8:00a. inside containers equipped with spark arresters & are located within a cleared area that has at least 10 ft radius, & comply with all other laws & requirements.
    2. Camp fires contained within an established fire ring at an established campground provided fire is in compliance with BLM, Forest Service, & Ntl Park Service regs in effect at time.
    3. Charcoal & gas fires within enclosed grills.
    4. Use of acetylene cutting torches or electric arc welder provided torches or welders are used within cleared area with at least a 10 ft radius.
    5. Propane or open fire branding activities provided branding activities are conducted within a cleared area with at least a 10 ft radius.
    6. Flare stacks used in industry that meet governing body’s requirements.
    7. Use of chain saw provided chain saw has spark arresters properly installed & functioning.
    8. Federal, State or local fire or law enforcement officers participating in fire, emergency, & law enforcement activities.
  1. County Fire Warden shall promptly notify Board of County Commissioners of any changes in severity of fire danger & if a longer restriction not associated with a Red Flag Warning is required.

IT IS FURTHER RESOLVED, that penalties provided in W.S.§ 35-9-304 may be imposed for violations of this resolution; specifically a fine not to exceed 100.00 or imprisonment not to exceed 30 days or both to which may be added cost of restitution.



BE IT FURTHER RESOLVED that County Fire Warden Shall immediately notify Wy State Forester of limitation provided for by this Resolution, as well as any & all Commissioners’ Rules & Regs & shall assist in public notification by posting order & circulating it to all local media.
